The Nigeria Ombudsman known as Public Complaints Commssion perfom statutory functions such as, Receiving complaints from aggrieved persons against government agencies, corporate organisations or their officials; Investigates either on its own initiative or following complaints lodged before her; Recommends appropiate remedial measures to the aggrieved.
HOW DOES THE COMMISSION WORKS
Any person who is aggrieved with any of the following bodies can complain to pcc.
• a Department or Ministry of the Federal or state government;
• any Local Government Authority in the Federation.
• any Statutory Coporation or Public Institution set up by any Government in Nigeria.
• any Company incoporated by any Government or private individual in Nigeria.
• any oficer or servant of any of the aforementioned bodies.
The Public should hereby think of PCC as a referee who can look into all sides of a problem, (if convinced that the complaints are genuine, PCC could do what ever is possible within its statutory power to find a solution). For this reason, PCC shall ensure that administrative action by any person or body mentioned above will not result in the commitment of any act of injustice against any citizen of Nigeria or any person resident in Nigeria, and for that purpose shall investigate with care, administrative acts which are or appear to be:
• contrary to any law or regulation;
• mistaken in law arbitrary in the ascertainment of facts;
• unreasonable, unfair, oppressive or inconsistent with general functions of administrative organs;
• unclear or inadequately explained;
• improper in motivation or based on irrelevant considerations; or
• otherwise objectionable; and shall be competent to investigate administrative procedures of any court of law in Nigeria.
AFTER INVESTIGATING COMPLAINTS, WHAT CAN THE COMMISSION DO
After due investigation of any complaint; PCC may recommend to the appropiate person or responsible administrative agency any of the following steps; that a
• Further consideration of the matter be made
• modification or cancelliation of the offending administrative or other act be effected.
• full reason behind a particular administrative or other act be given;
And where appropiate, the PCC may refer cases where existing laws or administrative regulations or procedures are inadequate to the National Assembly or the appropriate Governor or any apppropriate person or body.
